Luxembourg: Modernisation of Insolvency Proceedings & Digitalisation (Bill No. 8735)

The Luxembourg Parliament has enacted Bill No. 8735, amending the Commercial Code and finalizing the implementation of the Law of 7 August 2023 on the preservation of businesses.

The legislation completes Luxembourg’s transposition of Article 28(d) of EU Directive 2019/1023 on preventive restructuring and insolvency.

LUXEMBOURG INSOVELNCY REFORM STATUTORY HIGHLIGHTS (2026) 
Electronic Court Filing 
Writs, petitions, and appeals in judicial reorganisations may be submitted digitally up to midnight on statutory dates.
Restructuring Mechanics 
Standardises judicial reorganisation by mutual agreement or court-sanctioned cram-down plans for Luxembourg funds/co's.

Establishes strict electronic reporting schedules for court-appointed insolvency administrators (*curateurs*).
